身体の筋肉が徐々に弱っていくALS＝amyotrophic lateral sclerosis（筋萎縮性側索硬化症）を患った林さん。彼女の世界を旅行したいという想いは、辛い病気との闘いの中、失望へと変わりました。ALSは別名Lou Gehrig’s diseaseといいます。

Ms.Yuri Hayashi's globetrotting wanderlust turned into despondence as, over the course of nine excruciating years of living with Lou Gehrig's Disease, she gradually lost control of her limbs, down to her hands and feet.

Lou Gehrig は1920年代から1930年代にかけてニューヨーク・ヤンキースで活躍した左投左打。三冠王をはじめタイトルを多数獲得したが、ALSのため、1941年37歳で亡くなりました。

治療が確立されていないこの進行性神経性疾患＝progressive neurological diseaseを患う中、林さんは安楽死を望むようになったとされます。ALSのことはincurable disease（不治の病、難病）とも。

Afflicted since 2011 and hardly able to move, she is believed to have wished to die by euthanasia.

二人の医師、大久保愉一被告（４２：写真左）と右：山本直樹被告（４３：写真右）は、去年11月、林さん（当時５１）に依頼され、胃瘻から薬物を注入し殺害した容疑で逮捕、その後起訴されました。

The Kyoto Prefectural Police believe the two doctors were paid to inject barbiturate sedatives into her gastric fistula, a device used to guide food directly to the stomach.

「バルビツール酸系」鎮静剤は、抗てんかん＝epilepsy薬などで用いられています。過剰投与は呼吸低下を引き起こし、欧米では医師による安楽死や死刑執行の際に使われるとされています。

The drug, which has strong side effects and causes dependence syndrome, can suppress breathing and lead to death if injected in large quantities. It is used by suicide-support groups in Europe and the United States.

Okubo, 42, who runs a clinic in Natori, Miyagi Prefecture, and Naoki Yamamoto, 43, a doctor residing in Tokyo’s Minato Ward, are accused of murder by contract（嘱託殺人） in the death of Yuri Hayashi, 51, an ALS patient who had expressed her desire to die in her blog.

二人は林さんの主治医＝attending physiciansなどではなく、大久保容疑者が2019年5月に開設した「安楽死研究会」という掲示板を通じて知り合ったとされます。掲示板は「静かに逝かせてあげるコツをシェアできたらと思います」などと書かれ、外国の自殺ほう助団体の費用を参考にしたと思われる130万円が、林さんから報酬＝remunerationとして支払われていたとのことです。

In May that year, an online bulletin board named “Euthanasia Study Group” was opened under an account believed to belong to Okubo. The bulletin board’s stated purpose was “to share tidbits of tricks of letting patients die quietly.”

投稿者に対しては、刑法違反に当たる「嘱託殺人」や「自殺幇助（ほうじょ）」という単語を使わないよう呼びかけていました。

They were asked to avoid using such expressions as “murder by contract” and “assisted suicide” because those acts could breach the law.　

手塚治虫さんの『ブラックジャック』の主人公は、どんな難病患者でも助ける信念の人ですが、対極的な登場人物、ドクターキリコは死に直面した患者を、法律に触れない方法で安楽死させていく“死神の化身”の異名を持つ銀髪の医師。大久保容疑者はこのドクターキリコに憧れを抱いていたとされます。

In the manga, Kiriko, who commits mercy killings for money, has a showdown with the protagonist, Black Jack, an unlicensed but genius surgeon who does everything possible to save his patients whose odds of living are slim.

日本国内では、薬物投与などで患者の死期を早める積極的安楽死positive euthanasia/ active euthanasiaは認められていません。安楽死の条件は以下。林さんは、4番以外当てはまっていなかったとされます。

These conditions, all of which must be met, are:

- the patient is suffering from unbearable physical pain;

- the patient's death is inevitable and imminent;

- all possible treatments have been exhausted and there are no alternative remedies to relieve or alleviate the pain; and　

- the patient has indicated a clear will to die.

「安楽死」の4要件

-患者が耐え難い肉体的苦痛に苦しんでいる。

-死が避けられず、死期が迫っている。

-肉体的苦痛を除去・緩和するために方法を尽くし、ほかに代替手段がない。

-生命の短縮を承諾する患者

メディアは、このような行為はヒポクラテスの誓詞の裏切りだといいました。

The media called such acts that are "just an easy way to hasten death" a betrayal of the Hippocratic Oath.

※the Hippocratic Oathヒポクラテスの誓いは、医師の倫理・任務などについての宣誓文。米国の大学の医学部の卒業式で使われています。

ヒポクラテスは紀元前5世紀に生まれたギリシャの医師。それ以前の呪術的医療を排し、科学的視点に基づく医学を発展させる基礎をつくったと言われ、「医学の父」と称されます。
