ハンセン病家族訴訟、熊本地裁が国の責任を認める初判決

熊本地裁は、6月28日、ハンセン病患者の家族の差別被害を防ぐ手段を取らなかったとして、国の責任を認める画期的な判決を下しました。

The Kumamoto District Court handed down a landmark ruling that blamed a wide range of government ministers and lawmakers  for failing to take action to prevent the spread of discrimination against family members of patients diagnosed with Hansen's disease.　

国家賠償に関する時効の起算点について、独自の解釈を示したことが、原告の救済につながりました。

The ruling reflected the court’s own interpretation of when to begin calculations for the statute of limitations on state compensation, leading to the relief of the plaintiffs.

政府は、1907年に隔離政策を開始し、多くの患者が家族から引き離され、療養所に隔離されました。

The segregation policy was put in place in 1907.Many patients were isolated in sanatoriums under a decades-long government policy between 1907 and 1996.

※ハンセン（ライ）病療養所は leprosarium とも言います。

療養所では、断種 sterilization や堕胎 abortion が強要されました。96年にらい予防法は廃止され、2001年に、政府は元患者に謝罪しましたが、家族の被害に、国の賠償責任を認めた判決は今回が初めてです。

熊本地裁の判決理由は、『隔離政策によって患者の家族が差別を受ける社会構造が形成され、就学・就労の拒否、結婚差別などの被害が生じ、家族関係の形成を阻害した』というものです。

The district court said the government's segregation policy against Hansen's disease patients "created a social structure that led family members to face from the majority of the population, triggered damage created by discrimination and prevented the formation of family ties."

その後、政府は「「筆舌に尽くしがたい経験をされたご家族のご苦労をこれ以上、長引かせるわけにはいかない」としして、控訴しない決定をしました。

 “We must not prolong the hardship of family members who have gone through something indescribable,” Abe said. “Though it’s a rare move, we’ve decided not to appeal against the ruling.”“We can’t let the sufferings of the family members, who have gone through indescribable experiences, last any longer,”

名誉回復を求める長い闘い末のニュースに、家族らは喜ばれました。

Victims and families were emotional, saying they were elated by the news after a very long fight for vindication.

7月24日には安倍首相が、政府を代表して元ハンセン病患者の家族と面会をして、謝罪をしました。

Prime Minister Shinzo Abe on July 24 met with family members of former Hansen's disease patients and offered his deepest apologies on behalf of the government.

原告団表の林さんは、もっと早い救済をするべきだったと述べられました。

Chikara Hayashi, the 94-year-old leader of the group of plaintiffs, said redress should have been provided to the families long ago.

子供の頃に病気になった母と離れ離れになった女性は、勇気を出して声を上げてよかったと語りました。

When she was a child, she was forcibly separated from her mother, a leprosy patient.“My relationship with my mother cannot be restored but I am so glad that I plucked up my courage and raised my voice,” she said.
